1. Purpose

These General Terms of Sale (GTS) govern all sales made on the website https://benix.shop/ to the general public. Benix offers original and unique moulds, sold either via immediate purchase or via offer by message. Any order implies unreserved acceptance of these GTS.

2. Products

  • Each product is unique, made in very limited series or as a one-off piece.
  • Photographs and descriptions are provided for information only. Minor differences between the product shown and the product delivered are possible.
  • Benix strives to guarantee the quality and condition of each product, but the customer acknowledges purchasing an item outside industrial standards.

3. User account

Creating an account allows you to:

  • manage your cart,
  • save products to favourites,
  • track orders.
  • The user is responsible for keeping their login details confidential and for all actions taken through their account.
  • Benix reserves the right to suspend or delete an account in case of fraud or abuse.

4. Order

4.1 Immediate purchase

  • The customer buys the product at the price shown on the site. The order is effective once payment is validated.

4.2 Offer by message

  • The customer may submit an offer via the site’s messaging system.
  • The offer becomes binding only after acceptance by Benix, which reserves the right to refuse any offer without justification.

4.3 Order confirmation

  • A confirmation is sent by e-mail upon payment validation or accepted offer.
  • Benix reserves the right to cancel any order in case of technical problems, fraud, or product unavailability.

5. Price and payment

  • Prices are shown in euros including VAT.
  • Payment is made online by bank card via a secure provider.
  • Shipping costs are flat-rate and charged to the customer at checkout.
  • Benix reserves the right to change prices at any time, but validated orders remain at the price displayed at purchase.

6. Delivery

  • Products are shipped to the address provided by the customer when ordering.
  • Delivery times are indicative and Benix cannot be held liable for delays beyond its control.
  • Benix undertakes to pack and ship products with care to avoid damage.
  • In case of damage or loss during transport, the customer must inform Benix within 48 hours of receipt to initiate a refund or replacement procedure.

7. Right of withdrawal and returns

  • Under legislation on unique goods, the right of withdrawal does not apply.
  • Returns are accepted only if the product is defective or damaged on delivery.
  • Any request must include proof (photos) and be submitted within 7 days of receipt.

8. Liability and limitation

  • Benix is liable for direct damage related to defective or damaged products on delivery.
  • Benix cannot be held liable for indirect damage, loss of profit, or misuse of products.
  • As products are unique and fragile, the customer acknowledges purchasing an item that may require specific precautions.

9. Intellectual property

  • All site content (texts, images, designs, moulds) is protected by copyright.
  • Any reproduction, distribution, or use without written authorisation is prohibited and constitutes infringement.

10. Personal data

Information collected is used for:

  • order management,
  • shipping,
  • commercial communication with consent.

Under applicable law, the customer may exercise their rights of access, rectification, objection, or deletion of their data.

11. Force majeure

Benix cannot be held liable in case of force majeure or events beyond its control (fire, flood, strike, delivery provider failure, etc.) preventing fulfilment of orders.

12. Security and fraud prevention

  • Benix uses secure payment systems and may suspend or cancel any suspicious transaction.
  • Any attempt at fraud or abusive use of the site may result in legal action.

13. Disputes and applicable law

  • These GTS are governed by French law.
  • Any dispute shall be submitted to the competent courts within the jurisdiction of VELVET GALERIE’s registered office.
